Terms and Conditions
Definitions:
Lawsec
Refers to the trading entity Lawsec (ABN:1115 9820 569) a business of Myown Pty Ltd (ACN:159 820 569)
Candidate
Refers to a person or persons Lawsec has identified as interested in employment or partnership with the client. These persons may include, secretaries, legal or research assistants, typists, bookkeepers, paralegals, solicitors, partners, directors, mediators, adjudicators, investigators, estimators, actuaries, and data entry personnel.
Placement fee:
Where a client employs a candidate, introduced by Lawsec they will be charged a placement fee equal to 15% of the net annual wages (52 weeks) negotiated for the candidate, or if the period is less than one year, 15%of net the wages of the employment period.
Terms of Payment:
Invoicing for the placement of a candidate will commence upon the starting day of employment, to be paid within 14 days from that date.
GST is calculated on top of Lawsec’s placement fee and is included in all invoices
All advertising costs will be invoiced to the client weekly. Advertising costs will reflect the specifications of the client and the costs involved in placement. Advertising costs are to be paid within 14 days from the invoiced date.
Advertising costs:
All advertising costs incurred during the recruitment process are billed to the client on a weekly basis.
Client Obligations
Later employment:
Where Lawsec has introduced a client to a candidate, they will be bound by these terms, and liable to pay Lawsec a placement fee for a period of 52 weeks dating from the introduction, should they employ or indicate an intention to employ the introduced candidate/s in the future without using Lawsec.
A client’s intention to employ a candidate may be express or by implication.
Referring Candidates to others
Where Lawsec has introduced a candidate to a client, the client will be bound by these terms and liable to pay a placement fee where they either directly or indirectly refer a candidate to any other person, or entity and this candidate is employed due to that referral. This will apply to situations, where there may be a pre-existing relationship between the client and candidate, or where the client is concurrently informed of the candidate’s interest by a person or entity other than Lawsec.
Deemed Introduction
Lawsec will be considered to have introduced a candidate to a client, where following a brief from the client, a candidate is alerted to an opportunity of employment or partnership with the client and this is then communicated to the client.
Our Responsibility
While Lawsec does its utmost to ensure the veracity of a candidate's background and qualifications its responsibility for any misrepresentations, errors, omissions, false assumptions and loss, error, expense, damage, or delay to the client or third parties, caused by a candidate, will be limited to the placement fee charged to the client.
Acceptance of Terms
The client will have accepted these terms and conditions, and the schedule of fees upon their receipt, unless varied by agreement in writing prior to the engagement of Lawsec.
Third Party Links
Where links appear on our website linking to websites operated by third parties these are not to be taken as part of the Lawsec website and are not Lawsec’s responsibility or under their control. Where a person uses a link or links to a third party website they do so entirely at their own risk.
Severability
Should any of part of these terms and conditions be unenforceable at law, the enforceability of any other part or parts of these terms and conditions will be unaffected.
Applicable Law
These terms and conditions, and any contract between us, as well as any specific and additional terms which govern your use, membership, or access to this site will be governed and interpreted in accordance with the laws of the state of Queensland, Australia.
